These Terms of Use (‘Terms’) govern your access to and use of the website www.ethix.net.in (‘Website’), the ETHIX website available on Android and iOS (‘App’), and all related digital services (collectively, ‘Services’) provided by ETHIX (‘Company’, ‘we’, ‘us’, ‘our’), a Private Limited Company incorporated under the Companies Act, 2013, having CIN N/A (Sole Proprietorship), with its registered office at Bizzbay Commercial Complex, Office 151, Off NIBM Road, Pune – 411048, Maharashtra.

By accessing, browsing, or using our Website, downloading or using our ETHIX website, or engaging with any of our Services, you (‘User’, ‘you’, ‘your’, ‘Investor’, ‘Client’) agree to be bound by these Terms, our Privacy Policy, and all applicable laws, regulations, and guidelines. If you do not agree with any of these Terms, you must not use our Website, App, or Services.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated ‘Last Updated’ date. Your continued use of the Services after any modification constitutes your acceptance of the revised Terms.

2. About the Firm & Nature of Services

ETHIX is a Sole Proprietorship of Mehran Felfeli, registered with the Association of Mutual Funds in India (AMFI) as a Mutual Fund Distributor under ARN: 66910.

We are engaged in the distribution of mutual fund schemes and Mutual Fund products of various Asset Management Companies (AMCs) registered with SEBI. Our services include mutual fund distribution, Mutual Fund distribution, risk profiling, scheme recommendation, portfolio review, and related investor servicing.

Important Clarification:

We are a Mutual Fund Distributor and NOT a SEBI-registered Investment Adviser (IA) under SEBI (Investment Advisers) Regulations, 2013.
We do not provide investment advisory services, financial planning, wealth management, or any service that requires SEBI IA registration.
Any scheme recommendation or suggestion provided by us is incidental to our mutual fund distribution activity and should not be construed as investment advice.
We receive trail commission from AMCs for distributing Regular Plan mutual fund schemes. Commission is part of the scheme’s Total Expense Ratio (TER) and is NOT charged separately to investors.
Investors are free to invest in Direct Plans directly with AMCs, which have lower expense ratios as they do not include distributor commission.

3. Eligibility

To use our Website, ETHIX website, and Services, you must:

Be at least 18 years of age (or the age of legal majority in your jurisdiction).
Be a resident of India or a Non-Resident Indian (NRI) eligible to invest in Indian mutual funds under FEMA regulations.
Have a valid PAN (Permanent Account Number) issued by the Income Tax Department of India.
Have completed or be willing to complete KYC (Know Your Customer) verification as mandated by SEBI and AMFI.
Have a valid bank account in your name for processing mutual fund transactions.

Investments in the name of minors can be made only through a parent or legal guardian in accordance with SEBI regulations. The guardian shall be bound by these Terms.

4. User Accounts & Registration

To access certain features of our Website and ETHIX website, you may be required to create an account or register through our transaction platform partner (NSE Invest MF Platform). By registering, you agree to provide accurate, current, and complete information and to maintain the confidentiality of your credentials.

5. No Guaranteed Returns

Mutual fund investments are subject to market risks. The Firm does not guarantee any specific returns, minimum returns, or capital protection on any investment. Past performance is not indicative of future returns. The value of investments can go up or down based on market conditions. Investments in Mutual Fund products involve higher risk including potential loss of capital.

6. Commission & Fees

We receive trail commission from AMCs for distributing Regular Plan mutual fund schemes. This commission is part of the scheme’s Total Expense Ratio (TER) and does not increase your investment cost. No separate fee or commission is charged directly to investors for mutual fund or Mutual Fund distribution. Commission details are available on our Commission Disclosure page.

7. Privacy & Data Protection

Your personal and financial data is collected, stored, and used in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDPA). We do not sell, rent, or share your data with third parties for marketing purposes. Refer to our Privacy Policy for complete details.

8. Intellectual Property

All content, logos, trademarks (including the ETHIX brand and logo), images, and design elements on this website and app are the property of ETHIX or their respective owners. Unauthorized use, reproduction, distribution, or modification of any content is prohibited.

9. Third-Party Links

Our website and ETHIX website may contain links to external websites (AMC websites, SEBI, AMFI, SCORES, RTAs, etc.) provided for your convenience. ETHIX does not control, endorse, or assume responsibility for the content, accuracy, privacy policies, or security of these external sites.

10. Limitation of Liability

ETHIX makes no warranties or representations, express or implied, on products offered through this platform or the ETHIX website. It accepts no liability for any damages or losses, however caused, in connection with the use of, or on the reliance of its products or related services.

11. Grievance Redressal

For complaints, contact mehran@ethix.net.in. Our complete grievance redressal mechanism with escalation matrix and timelines is detailed on the Investor Grievance Redressal page. Unresolved complaints may be escalated to SEBI SCORES (scores.sebi.gov.in) or SMART ODR (smartodr.in).

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms or the use of this website or ETHIX website shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

13. Amendments

We reserve the right to modify, update, or revise these Terms and Conditions at any time without prior notice. The latest version will always be available on this page. Your continued use of the website or ETHIX website after any changes constitutes your acceptance of the revised terms.

Risk Factors – Investments in Mutual Funds are subject to Market Risks. Read all scheme related documents carefully before investing. Mutual Fund Schemes do not assure or guarantee any returns. Past performances of any Mutual Fund Scheme may or may not be sustained in future. There is no guarantee that the investment objective of any suggested scheme shall be achieved. All existing and prospective investors are advised to check and evaluate the Exit loads and other cost structure (TER) applicable at the time of making the investment before finalizing on any investment decision for Mutual Funds schemes. We deal in Regular Plans only for Mutual Fund Schemes and earn a Trailing Commission on client investments. Disclosure For Commission earnings is made to clients at the time of investments. Option of Direct Plan for every Mutual Fund Scheme is available to investors offering advantage of lower expense ratio. We are not entitled to earn any commission on Direct plans. Hence we do not deal in Direct Plans.
